UPnator Terms of Service

Version: 2026-08-11.1 Effective date: 11 August 2026

1. Operator and scope

  1. The service provider and operator of the UPnator brand (the “Operator”) is Jarosław Staroń, carrying on business as 9ne.pl Jarosław Staroń, Polish tax identification number (NIP) 8942787122, ul. Starobielawska 32a, 54-061 Wrocław, Poland.
  2. Service contact: support@upnator.com; legal matters: legal@upnator.com; security: security@upnator.com.
  3. The service is intended exclusively for businesses, organizations and persons acting professionally. It is not offered to consumers.

2. Service and plans

  1. UPnator provides availability, performance and voice monitoring, measurements from public probes or private agents, incident detection, alerts, status pages and reports.
  2. Features, limits, intervals and retention depend on the active plan and the organization’s effective entitlements shown in the application.
  3. The Free plan is available without charge. Paid plans are billed on a recurring basis at the price, currency and interval shown before purchase confirmation.
  4. The Operator may develop or change features, provided that a paid plan retains its essential purpose. Material changes are communicated in the application or by email.

3. Account and security

  1. The user provides accurate information, protects passwords, API keys, tokens, recovery codes and authentication devices, and does not make the account available to unauthorized persons.
  2. Suspected account compromise must be reported promptly to security@upnator.com.
  3. The organization administrator is responsible for member roles, alert recipients, integrations, monitored targets and the organization’s compliance with law and third-party agreements.

4. Payments and subscriptions

  1. Stripe processes payments for paid plans. UPnator does not store full payment-card details.
  2. A subscription renews automatically for the next billing period until the organization owner schedules cancellation in the Stripe customer portal or agrees another arrangement with the Operator.
  3. Cancellation normally takes effect at the end of the paid period. Paid features remain available until that date unless security, law or a failed payment requires otherwise.
  4. Plan changes and any prorated amount are shown before confirmation. No charge is made without express confirmation in Checkout.
  5. Prices and applicable taxes are shown in Checkout. Sales documents are issued using the billing details supplied by the customer.
  6. Once a paid period has begun, fees are non-refundable except for Operator error, an accepted complaint or where mandatory law requires otherwise.

5. Acceptable use

  1. The user may monitor only resources, domains, systems, numbers or accounts that the user owns or is expressly authorized to monitor.
  2. Prohibited conduct includes testing third-party infrastructure without permission, bypassing safeguards or limits, generating unauthorized traffic or costs, disrupting the service, attempting to access another organization’s data, or using the service in breach of law, privacy or communications confidentiality.
  3. Voice users must use controlled test destinations and appropriate carrier and anti-fraud limits.

6. Data, confidentiality and ownership

  1. The user retains rights in submitted data and configuration and authorizes the Operator to process them as needed to provide, secure and improve the service.
  2. Personal-data processing is described in the Privacy Policy. The DPA may apply where UPnator processes data on behalf of an organization.
  3. UPnator code, brand, documentation and interface remain the property of the Operator or its licensors.
  4. The Operator may use voluntary suggestions and defect reports to improve the service without disclosing the user’s confidential information.

7. Availability and support

  1. The service is provided with reasonable care. A guaranteed SLA applies only where expressly stated for a plan or in a separate agreement.
  2. The Operator may perform maintenance, restrict a feature that creates a security or cost risk, and deploy urgent fixes without prior notice.
  3. UPnator supports observability but does not replace the customer’s safeguards, redundancy, backups, telecommunications limits or business-continuity plans.

8. Suspension, cancellation and deletion

  1. The Operator may suspend an account following a breach, security threat, failed payment, cost risk or legal requirement.
  2. The user may cancel a subscription and request account deletion in the application. A team organization requires an ownership transfer first, and an active paid subscription must be canceled.
  3. After the grace period, data is deleted or anonymized under the Privacy Policy, except for records subject to mandatory accounting, tax or evidentiary retention.
  4. The Operator may discontinue the service on 30 days’ notice. Immediate termination is permitted for serious breach, abuse or legal obligation.

9. Liability and complaints

  1. To the extent permitted by law, the Operator is not liable for indirect loss, lost profits, data loss resulting from the user’s failure to maintain backups, or costs caused by misconfiguration or unauthorized targets.
  2. The Operator’s aggregate liability is limited to fees paid for the service during the three months preceding the event, or PLN 1,000 for the Free plan, except for liability that cannot be limited.
  3. Complaints may be sent to support@upnator.com. The Operator responds without undue delay and no later than 14 business days.

10. Changes to these Terms

  1. The Operator may amend these Terms for legal, security, product, supplier or payment-model reasons.
  2. Material changes are communicated at least 14 days in advance unless law or security requires an urgent change. The user may cancel the subscription before the change takes effect.
  3. Continued use may require acceptance of the new version.

11. Governing law

  1. These Terms are governed by Polish law. Disputes connected with professional use are subject to the court having jurisdiction over the Operator’s place of business unless mandatory law provides otherwise.
  2. If one provision is invalid, the remaining provisions remain effective.
  3. These Terms, the Privacy Policy, any DPA and individual arrangements form the service terms; the DPA prevails for personal-data processing.
